Robert M. Logan can help during your time of loss
The California Probate Code consists of thousands of separate sections governing every aspect of probate—each another reason to enlist a legal professional to deal with this unwelcome onslaught of paperwork, filings, and court appearances.
Losing a loved one is often a traumatic occasion. Needing to dedicate hundreds of hours to settle your loved one’s estate adds insult to injury. And, if the estate is not in perfect order, expect to expand those hundreds of hours into thousands. Then add the stress of travel if you do not live in the same city or neighborhood. Clearly, hiring reliable counsel to handle the probate process is necessary.
Even a will is no defense against probate in California. The law says that if the estate held in the decedent's name is valued at $100,000 or more, is not in a trust, and does not have a beneficiary designation, then the estate must go through the entire probate process. All assets in probate will be subject to state-mandated attorney and personal representation fees, as well as court costs.

Did you know?
Every person needs to have an estate plan in place to assure that their assets will be distributed, and their children protected, according to their wishes upon their death. Furthermore, estate plans should be updated regularly, especially upon the occurrence of major life events such as marriage, birth, adoption, divorce, or if a named beneficiary dies.
Family Law Center is pleased to announce that we offer affordable estate planning services for the Sacramento area. Whether you need a new estate plan or an update to an existing estate plan, we can help you.
How divorce affects your existing estate plan
Wills
- Executor of your estate – generally, a married person will appoint his/her spouse as primary executor. Upon divorce, it is wise to change your executor, or reaffirm your former spouse as executor, if desired.
- Distribution of assets – the provisions you made during marriage for distribution of your assets may no longer reflect your wishes.
- According to state law, if you die and have not updated your will:
- Any gift to your ex-spouse will be automatically revoked
- Any gift to your ex-spouse’s children (who are not your children) may be revoked
- Nomination of your ex-spouse as executor will be revoked; if you did not name an alternate executor, the court will appoint one for you
Revocable Living Trusts
- Your trust is not affected by your divorce and remains revocable by either spouse at any time. We therefore recommend that your current trust be revoked and a new trust drafted to reflect your needs and wishes more appropriately, then re-title your assets to the new trust as soon as possible.
Advance Health Care Directives and/or Durable Powers of Attorney
- Generally, a married person will appoint his/her spouse to act as agent for health care and financial decisions. After divorce, it is important to revise these documents to appoint a new agent, or reaffirm your former spouse as your agent, if desired.
Children
- After divorce, it is very important to update your estate plan to reflect who you would nominate as guardian for your children.

Robert M. Logan Business Transaction Lawyer
There are several important reasons you want an experienced business transaction attorney to assist you with any business contracts. First and foremost, you want to ensure that you will receive the benefit of your bargain, i.e., you pay and receive everything you expected.
This is not to say that your supplier, purchaser, seller, or vendor is out to cheat you. It is unfortunate, but the courts are flooded with lawsuits from parties who each had a different understanding of the agreement. That is why it is important to spell out the terms in an unambiguous manner, and in a legally binding contract.
